In 1999, the City of Bromley levied a tax Aof Seventy Five Dollars ($75.00) per mobile home situated within the confines of the City,@ and a tax Aof Sixty Dollars ($60.00) for the provision of life-squad and other emergency but non-fire related services for each residential unit or lot and each business unit within the corporate limits of the City.@ In August 1999, Gail Smith, the only member of the Bromley City Council to have voted against the two provisions, brought suit against Bromley, its Mayor, and its clerk (collectively the city) to have the provisions declared unconstitutional.
