Tonia received bachelor's, master's, and law degrees from North Carolina Central University.

Tonia previously worked as a public defender for the State of North Carolina and as an attorney at Capote & Associates. She has also worked as an assistant professor at Colorado Technical University and as adjunct faculty at Claremont Lincoln University and John Wesley University.

Tonia A. Cutchin currently serves as the Superior Court Judge in Superior Court District 18E. She was appointed in 2022. She previously served as a District Court Judge in Guilford County.

As superior court judge, she oversees cases involving criminal felonies, the administration of wills and estates, evictions of renters, and divorce proceedings, and exercises authority to review and correct the rulings of lower courts.

As a state district court judge, she oversaw all felony, probate, and civil cases, ruled in all civil actions against the state seeking financial payment, authorized naturalization procedures, and exercised authority to review and correct the rulings of lower courts.

As a public defender, she provided legal counsel and representation to juveniles and criminal defendants who were unable to hire an attorney.

As an attorney at Capote & Associates, she researched, drafted, and filed legal documents, and provided defense and counsel to clients.

- The Superior Court Judge hears both civil and criminal cases. Superior Court Judges try civil cases involving more than $10,000. Superior Court Judge hear appeals of misdemeanors and infraction cases that were first heard in the District Court,
- They make decisions on bail, meaning a Superior Court Judge could keep a non-dangerous person in jail before they are convicted by setting a high bail.
- In each district (except Wake County), the most senior judge in years of service is designated the senior resident superior court judge. They are responsible for various administrative duties, including appointing magistrates and some other court officials, and managing the scheduling of civil cases for trial.
- Superior court judges rotate among the districts within their divisions.  
- The Superior Court Judge is elected for 8-year terms. Elections are partisan.
