Legal Experience

The guilty plea comes just over a year after an investigation focused on Nix into the misappropriation of court funds led by the North Carolina Administrative Offices of the Courts and the State Bureau of Investigation. Nix was the bookkeeper at the time of the investigation according to District Attorney Seth Banks. “There were discrepancies found in bookkeeping,” Mark Cody, Madison County Clerk of Superior Court, said following Nix’s arrest on an embezzlement by a public official charge in May 2017. “The employee was immediately suspended. Two days later, after further investigation by the NC Administrative Offices of the Courts and myself, the employee was terminated from her position here at the courthouse. The matter was then turned over to authorities for investigation.”

During a regular audit in March 2017, irregularities were discovered, consisting of a series of checks made payable to Nix, who was, at that time, the bookkeeper for the Madison County Clerk of Superior Court. Upon discovering the irregularities, Madison County Clerk Mark Cody asked the district attorney to investigate. Cody suspended Nix, confiscated her key to the courthouse, cut off her access to the courthouse computer systems and secured her checkbook.
