Public Safety

“The loophole created for the developers of this data center to secretly set electricity rates behind closed doors and outside of the public process is new, rare, and a dangerous recipe for massive price hikes for Arizona consumers,” said Attorney General Mayes. “That’s why my office is stepping in.”

Attorney General Mayes asserts that a thorough review of TEP's private energy agreement for Project Blue by the Commission could have eliminated a key flaw: a provision allowing TEP and the data center customer to set their own electricity rates without Commission oversight.

The Attorney General’s filing requests that the Commission schedule a full evidentiary hearing and grant intervention to the State of Arizona and the City of Tucson, with full procedural rights, including pre-hearing discovery, the presentation of oral and written evidence, cross-examination of witnesses under oath, and the ability to subpoena witnesses.

“The public deserves transparency and accountability when utilities enter into unprecedented agreements that may affect electricity rates and grid reliability across Arizona,” Attorney General Mayes said. “The Commission must ensure that its decisions are grounded in a complete record and made in the public interest.”

Warren Petersen Public safety is the goal here. When someone is arrested for a violent crime, law enforcement sharing basic information with federal authorities helps keep our communities safe. I wrote the AZ ICE Act because our sheriffs and corrections officials asked for a clear, consistent framework to work with federal authorities on people already in custody for breaking the law, which keeps dangerous individuals from being released back onto our streets. Arizona voters across party lines supported the Secure the Border Act because they want practical, effective public safety measures. As Attorney General, I'll keep the focus on cooperation that protects families and communities, handled responsibly and within the law.

Attorney General Mayes has used consumer protection laws on issues from housing to the environment. How would you use this tool as attorney general?

Warren Petersen — Consumer protection is a powerful tool and I intend to use it to actually protect consumers and not advance a political agenda. I have already laid the groundwork on this. Some of the things I will be targeting are AI driven deception, robocalls, romance scams, and predatory schemes.
